Definitions
- “H2C”, “we”, “us”, “our” means Holidays2Cherish Ltd.
- “Customer”, “you” means the person making the booking.
- “Principal” means an ATOL-licensed tour operator or flight supplier (e.g. Travelpack).
- “Land-Only Arrangements” means accommodation, transfers, tours, experiences, or ground services not including flights.
- “Flight-Inclusive Arrangements” means any booking that includes flights.
Our Role – Agent vs Principal
Flights and Flight-Inclusive Arrangements
- H2C acts solely as a retail agent for the ATOL-licensed Principal.
- The Principal is the organiser of all flight-inclusive arrangements.
- Your contract for flights and any flight-inclusive holiday is with the Principal, not with H2C.
- The Principal’s Terms & Conditions apply to that part of your booking.
Land-Only Arrangements
- For land-only arrangements sold directly by H2C, we act as the Principal.
- Land-only arrangements do not include flights and are not ATOL protected.
Separate Contracts
Where a booking includes both:
- flights via an ATOL-licensed Principal, and
- land-only arrangements sold by H2C,
these constitute separate and independent contracts, invoiced and governed separately.
ATOL Protection
- All flights and flight-inclusive arrangements are protected by the ATOL-licensed Principal.
- An ATOL Certificate will be issued naming the responsible ATOL holder.
- H2C does not provide ATOL protection for land-only arrangements.
Payment Handling
- When H2C collects payment for flights or flight-inclusive arrangements, we do so as agent for the Principal only.
- All such funds are passed to the Principal in accordance with our agency agreement.
- H2C retains only the agreed commission.
Land-Only Arrangements (H2C Products)
H2C land-only arrangements may include:
- hotels and villas
- transfers and ground transport
- tours and excursions
- experiences and activities
These are sold independently of flights and are not ATOL protected.
H2C’s responsibility is limited to arranging these services with reasonable skill and care.
Combining Flights and Land Services
To comply with UK travel regulations:
- H2C will not combine flights and land-only services into a single package price unless the entire package is supplied by the ATOL-licensed Principal.
- Separate invoices and contracts will always be issued where applicable.
Supplier Failure
- For flight-inclusive arrangements, financial protection is provided by the ATOL-licensed Principal.
- For land-only arrangements, H2C is not responsible for supplier insolvency.
- Where possible, H2C will assist in sourcing alternatives, but refunds depend on supplier reimbursement.
Customer Responsibilities
You are responsible for:
- ensuring names match passports exactly
- passport validity and visa requirements
- purchasing appropriate travel insurance
- checking all documents within 24 hours of receipt
- arriving on time for flights, transfers, and activities
H2C is not liable for losses arising from incorrect information or failure to meet these obligations.
Liability Limitations
To the fullest extent permitted by law:
H2C is not liable for:
- airline delays, cancellations, or schedule changes
- acts or omissions of the Principal
- supplier insolvency
- force majeure events (weather, strikes, political events)
- loss of enjoyment or indirect losses
For land-only arrangements, H2C’s liability is limited to the amount paid for the affected services.
Complaints
- Complaints relating to flights or Principal-supplied arrangements must be directed to the Principal.
- Complaints relating to H2C land-only arrangements should be sent to:

We aim to respond within 14 days.
Data Protection (GDPR)
H2C complies with UK GDPR and the Data Protection Act 2018.
Data Collected
Personal details including names, contact details, passport data, and booking information.
Use of Data
Data is used solely to process bookings and provide travel services.
Data Sharing
Data is shared only with:
- ATOL-licensed Principals
- airlines (via the Principal)
- hotels, DMCs, and local suppliers
where necessary to fulfil your booking.
We do not sell personal data.
Governing Law
These Terms & Conditions are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
General Disclaimer
These Terms & Conditions are designed to allocate responsibility clearly and minimise legal exposure.
They do not remove statutory consumer rights and cannot prevent all legal claims.
